DMV Penalties

If you drive in the state of California, you are required to take a chemical test if a police officer arrests you for driving under the influence of alcohol and / or drugs. If you refuse the chemical test, the DMV penalties can result in longer suspensions. Additionally, if you do take a chemical test and it is found that you have a BAC of .08 or higher, your driving privileges can also be suspended. After your driver’s license has been taken away when arrested, you have the right to drive on the temporary permit issued by the police officer for up to 30 days. If you want to request a DMV administrative hearing to challenge the suspension of your license, you must do so within 10 days of your arrest. Once you request a DMV hearing, if the DMV stays the suspension, you can then legally drive until the hearing is resolved, which usually takes longer than 30 days.
